Important – Please carefully read and understand these terms and conditions of use, privacy and purchase before watching any or reading any of our patient information and educational material or placing an order with HELP (health education on lymphoedema) Online. 

Privacy Policy

The Australian Institute of Lymphoedema Pty Ltd (referred to as Help Online, we, our or us) makes online services available to you via www.helponline.com.au, helponline.teachable.com, and our social media accounts on Facebook, Instagram, LinkedIn, Youtube and Twitter (referred to as HO Information & Services).
When you use our HO Information & Services you are trusting us with your information. We understand that this is a big responsibility and we work hard to protect your information and put you in control.
This Privacy Policy is to help you understand what information we collect, why we collect it, and how you can update, manage and delete your information.
By enrolling, subscribing to or accessing HO Information & Services, you consent to and accept our Privacy Policy and to our use of your personal information as provided for in this Privacy Policy and our Terms. If you do not agree to this, please do not enrol, subscribe to or access HELP Online. Your continued accessing and/or subscription to HO Information & Services after the posting of any changes to our Privacy Policy (and or Terms) will be deemed to be your acceptance of those changes. For your assistance HO Information & Service users (referred to as Users, you, your) who have subscribed will be emailed and informed of periodic updates to our Terms and our Privacy Policy.

P1. Scope Of This Privacy Policy:
P1.1 This Privacy Policy governs the way HELP Online collects, uses, maintains and discloses information collected from Users of HO Information & Services.
P1.2 This Privacy Policy applies to all general information, education and services about lymphoedema and any other services and products offered by HELP Online (HO Information & Services).
P2. Personal Information:
P2.1 Personal information is information or opinion that identifies a User, including photographs, or information which, together with other information, could be used to identify a User, like a street address. We may collect personal information from Users in a variety of ways, including, but not limited to, when a User subscribes to any HO Information & Services, subscribes to a newsletter, views or downloads any content, and in connection with other activities, services, features, or resources we make available through HO Information & Services.
P2.2 Users may visit HO Information & Services and HELP Online will collect personal information (such as your name and email address) from Users if they voluntarily submit such information to us through the checkout process or opt in process for subscriptions to a HO Information & Service mailing list. Users can refuse to supply personal information but doing so may prevent them from engaging in certain HO Information & Service related activities or having access to all HO Information & Services.
P2.3 Registration information is required to enable you to login to HO Information & Services and for the delivery of any promotional materials, services or products by HELP Online. 
P2.4 We use third party website hosting software, email integration software and learning management systems that may be located overseas or may have storage or processing facilities located overseas. Unfortunately, few service providers are able to offer storage facilities located in Australia only. We aim to use only reputable providers who are able to store the information you have provided to us securely. When you use our services, you agree to the incidental transfer of your data overseas. What this means for you is that your information may be accessible by the agencies of foreign governments where the data is located.
These third-party websites, such as Teachable (a learning management system), are governed by their own terms and conditions and privacy policies. They may each collect your personal information differently and you should read their terms and conditions and privacy policy.
P3. What Personal Information We Collect:
P3.1 HELP Online’s primary purpose in collecting information from or about you is to provide you with a smooth and efficient information experience.
P3.2 Our Checkout software is managed by Clickfunnels (third party website hosting software) and Teachable (third party learning management system). We collect your name, address, phone number and email. You will create your own password for HO Information & Services and can re-set this as you require within Teachable.
P3.3 Credit card details are not stored by HELP Online but are processed by secure 3rd parties (STRIPE, Paypal or other programs in use as appropriate which involve secure payment processing gateway systems).
P3.4 If you sign up to a membership credit card details will be remembered for your convenience by HELP Online through the third party processing payment, not by HELP Online directly. If your credit card details expire and your payment fails to process then access to the membership area will be cancelled. HELP Online reserves the right to do this without written notification and it is therefore your responsibility to maintain the accuracy of your payment details.
P3.5 We do not collect personal information about children and our services are not intended to be used by people under the age of 18 years.
P4. How We Use Collected Personal Information:
P4.1 HELP Online may collect and use Users’ personal information for the following purposes:
• To improve customer service. Information you provide helps us respond to Users requests and support needs more efficiently.
• To abide by tax regulations and include appropriate details on purchase receipts (if applicable).
• To personalize the User experience and understand usage trends. We may use information in the aggregate to understand how our Users as a group use the services and resources provided by HELP Online.
• To send periodic emails. We may use User email addresses to send Users information and updates pertaining to their involvement with HELP Online. User email addresses may also be used to respond to User inquiries, questions, or other requests.
P4.2 Please note that testimonials are an exception to our usual privacy rules. We will always ask for permission to use any testimonial received before initially posting the testimonial on our website or to social media platforms, such as Facebook. If you do participate in HELP Online promotional activities or provide a testimonial you consent to Clause 9 of HELP Online’s Terms (as described below) and allow public use of the information received in the testimonial, including your name, qualification and country.
P5. Sharing Your Personal Information:
P5.1 We do not sell, trade, or rent User personal information to others. We will not share your information with third parties unless we are required to do so by law or must do so in order to allow functionality of a product or services for which you have subscribed or opted-in for.
P6. Updating or requesting copies of Your Personal Information:
P6.1 You may request copies of the information we hold about you. You have the ability to make a request to amend or correct that information. If we do not agree with your requested change, we will keep a copy of your request with our information
P6.2 You can contact us at info@helponline.com.au if you need to update any of your information that you provided upon Checkout or upon signing up for a subscription.
P6.3 You can update your own HO Information & Services User profile on helponline.teachable.com by pressing on your profile icon and editing your profile.

P7. Facebook Community Groups and HELP Online memberships area:
P7.1 Any HELP Online Facebook community group is designed to provide interaction between members. By joining HELP Online's Facebook page you accept that names of members are publicly visible and joining the group is at your own risk. Facebook has it is own terms of use and privacy policy.
P7.2 HELP Online reserves the right to monitor participation and to remove any false or offensive material hosted to any HELP Online Facebook page and any members that violate the rules of the group. Group rules are displayed at the time of joining and as a pinned post.
P7.3 Any HELP Online membership area is designed to provide interaction. Comments will be enabled on content. Any comments that you make will be publicly visible. HELP Online reserves the right to monitor participation and to remove any false or offensive material and comments, but is not obliged to do so.
P8. Device & Usage Information Including Our Cookies Policy: 
P8.1 When you interact with a HO Information & Service, we automatically receive and store certain information from devices that you use to access a HO Information & Service. This information is collected passively by using various technologies and includes the type of internet browser or mobile device you use, any website from which you have accessed HO Information & Services, your operating system and location data through an IP address that identifies the city and state where you logged into our platform or your precise geo-location if you have permitted your mobile device to provide that information to us. HELP Online stores such information itself. We can anonymise and aggregate the information collected for research purposes or any other purposes, and we can share this anonymised information with our affiliates, agents, business partners or other third parties (e.g. Google Analytics, Cancer Associations and Lymphoedema Advocacy groups).
P8.2 Cookies are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your hard drive. HO Information & Services and the software we use to track where Users find us from may set and access cookies on your computer or wireless device to track and store information about you.
P8.3 Web beacons, also known as pixel tags and clear GIFs, are electronic images that allow a website to access cookies and help track marketing campaigns and general usage patterns of visitors to those websites.
P8.4 Referrals - We use cookies, HTML5 local storage and other electronic technologies such as web beacons which are helpful in order to track where Users and user purchases come from. We provide some health professionals, cancer and lymphoedema advocacy organisations a proportion of subscription and or sale proceeds based on course referrals. We are able to do this based on understanding where Users are and through using unique URL’s (the address of a World Wide Web page) that are linked to a particular referring account. We will not provide your details to the referring party but the tracking allows for automatic payments to be debited from our system to the referring party.
P8.5 We can track Internet protocol (IP) addresses including the IP address that was used to access HO Information & Services and then subsequent IP addresses that are used to log into HO Information & Services including the day and time. This allows us to ensure that HO Information & Service Users have paid for access to HO Information & Services.

P9. Marketing Opt Out:
P9.1 Each marketing communication we send you will contain instructions permitting you to "opt out or unsubscribe" from receiving future marketing communications. In addition, if at any time you do not wish to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us via info@helponline.com.au. If you opt out of receiving marketing communications or other information we think may interest you, we can still send you emails about your User account or any products or services you have requested or received from us.

P10. Third Party Websites:
P10.1 Users may find advertising or other content in HO Information & Services that link to websites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these websites and are not responsible for the practices employed by websites linked to or from HO Information & Services. In addition, these websites or services, including their content and links, may be constantly changing. These websites and services may have their own privacy policies, terms and conditions and customer service policies. Browsing and interaction on any other website, including websites which have a link to HO Information & Service, is subject to that other website's own terms and policies.

P11. Changes to this Privacy Policy and Acceptance:
P11.1 HELP Online may update this Privacy Policy at any time. We encourage Users to check frequently this page for any changes. You acknowledge and agree that it is your responsibility to review this Privacy Policy each time you access HELP Online and become aware of modifications.
P11.2 By enrolling and or subscribing to HO Information & Services, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, please do not subscribe to or access HO Information & Services. Your continued accessing and/or subscription to HO Information & Services following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.
P11.3 If you have any concerns about our use of your personal information, please contact us via info@helponline.com.au and let us know what the problem is. We will respond to your concerns within 30 days. If you are not happy with how we manage your concerns, you can contact the Australian Privacy Commission, available at http://www.oaic.gov.au.

1. General
1.1 The Australian Institute of Lymphoedema Pty Ltd (referred to as Help Online, we, our or us) makes online services available to you via www.helponline.com.au, helponline.teachable.com, and our social media accounts on Facebook, Instagram, LinkedIn, Youtube and Twitter (referred to as HO Information & Services).
We provide general information and education on Lymphoedema online and the provision of HO Information & Services is governed by these terms and conditions (the Terms) and our Privacy Policy available above. 
1.2 By enrolling, subscribing to or accessing HO Information & Services the user (hereafter known as a “user” or “User”) consents to and accepts these Terms and our Privacy Policy, which forms a binding agreement between the User and HELP Online. If you do not agree to this, please do not enrol, subscribe to or access HO Information & Services. Your continued accessing and/or subscription to HO Information & Services after the posting of any changes to these Terms or our Privacy Policy will be deemed to be your acceptance of those changes.
For your assistance, HO Information & Service Users who have subscribed will be emailed and informed of periodic updates to our Terms and our Privacy Policy.
1.3 Please note that the Terms include an arbitration, jury trial and class action waiver. Except as otherwise described in the disputes section below, by using HELP Online you agree that disputes will be resolved by binding, individual arbitration in Sydney, Australia and you waive your right to a jury trial or to participate in a class action.
1.4 By subscribing to or accessing HELP Online, you expressly acknowledge that you have read, understand and accept all of these Terms.
2 Website Use and Scope - Disclaimer
2.1 The general patient information and education on lymphoedema material provided by HELP Online as part of our HO Information & Services is intended for use by adults. If you use HO Information & Services, you are affirming that you are at least 18 years old or the legal age of majority in your place of residence (whichever is greater), have the legal and mental capacity to enter into a binding contract with us, and have read these Terms and understand and agree to its them.
2.2 The HO Information & Services are for general information education purposes only and are not to be taken nor considered as medical advice for any individual. HO Information & Services are not intended to diagnose, prevent, cure, heal or treat any disease. You must see your doctor or qualified lymphoedema therapist for individual medical advice pertaining to your health needs, the prevention, risk reduction, diagnosis and treatment of lymphoedema or any medical conditions.
2.3 For the sake of clarity, HELP Online provides general information and education on lymphoedema only. We are not your doctor or lymphoedema therapist nor a school. We are also not a charity or a non for profit organisation. We do not endorse nor recommend the purchase of any products that you see demonstrated in the HO Information & Services. They have been included for information purposes only, to make you aware of lymphoedema products that are available.
2.4 We do not warrant after using our information products that you may be able to prevent or improve lymphoedema or any other medical condition. We encourage you to seek qualified professional help early and show you the evidence-based information behind these recommendations.
3. Mission of HELP Online
3.1 The Mission Statement of HELP Online is to enable the general public and health professionals to access high-quality information on the risk-factors for the development of and treatment of lymphoedema. We believe high quality relevant information can positively impact the lives of those at risk of lymphoedema or living with lymphoedema.
4. Website User Conduct and Restrictions-License Terms
4.1 HELP Online reserves all rights in its intellectual property including the right to effect statutory protection in Australia and beyond Australia under Australian and international copyright, trade mark, and other intellectual property laws, including all content, information, design elements, text material, logos, taglines, metatags, hashtags, photographic images, testimonials, personal stories, icons, video and audio clips, and downloads. Users must not seek to register or claim intellectual property rights in any Help Online material or its intellectual property.
4.2 Some of the HO Information & Services content is downloadable. Permission is granted for one copy of any downloadable materials the HO Information & Services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
4.2.1 modify or copy the materials;
4.2.2 use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
4.2.3 attempt to decompile or reverse engineer any software contained on HELP Online web site;
4.2.4 remove any copyright or other proprietary notations from the materials; or
4.2.5 transfer the materials to another person or 'mirror' the materials on any other server.
4.3 No material on the HO Information & Services may be copied, reproduced, distributed, republished, uploaded, displayed, posted, or transmitted in any way whatsoever (except for one copy to be retained for personal non-commercial use). The Australian Institute of Lymphoedema Pty Ltd, HELP Online and logos are proprietary marks of the Australian Institute of Lymphoedema Pty Ltd, and the use of those marks is strictly prohibited. Nothing herein gives you the right to use, copy, register as a domain name, reproduce, or otherwise display any logo, tagline, trademark, trade name, copyrighted material, patent, trade dress, trade secret, or confidential information the same or similar to that owned by the Australian Institute of Lymphoedema Pty Ltd, other than one copy for a User’s personal non-commercial use and information.
4.4 This license shall automatically terminate if you violate any of these Terms and may be terminated by HELP Online at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

5. Privacy Policy and Your Personal Information
5.1 We respect your privacy and the use and protection of your non-public, personal information. Your submission of personal information through the HO Information & Services is governed by our Privacy Policy available at https://www.helponline.com.au/termsandconditions
5.2 Before you use or submit any information through or in connection with HO Information & Services, please review relevant terms in our Privacy Policy carefully. By using any part of HO Information & Services, you consent to the collection, use, and disclosure of your information as outlined in these Terms and in our Privacy Policy.
5.3 HELP Online reserves the right to modify these Terms and our Privacy Policy in its reasonable discretion from time-to-time. The data controller is the Australian Institute of Lymphoedema Pty Ltd and can be contacted via info@helponline.com.au
6. Information You Provide and Prohibition Against Sharing Course Log-in Details
6.1 As a HO Information & Services User, you will be required to create an account with HELP Online. You warrant that the information you provide us is truthful and accurate, and that you are not impersonating another person. You are responsible for maintaining the confidentiality of any password you may use to access your HO Information & Services User account, and you agree not to transfer your password or user name, or lend or otherwise transfer your use of or access to your user account, to any third party. Should your usage data indicate, in HELP Online’s sole and exclusive discretion, that you are operating an agency account (meaning you are sharing HO Information & Services access details), you will be subject to cancellation of your HO Information & Services user account. This would mean that access to HO Information & Services will be terminated and future purchases, subscriptions or access will not be allowed. Whilst we would do our best to be transparent with our communication and our intent to cancel your HO Information & Services access, in the event of violation of our Terms, HELP Online reserves the right to cancel HO Information & Services access without written notification.
6.2 According to details within our Privacy Policy, we can track IP addresses including the IP address that was used to subscribe to HO Information & Services and then subsequent IP addresses that are used to log into HO Information & Services including the day and time. This allows us to ensure that relevant HO Information & Service Users have paid for access to so much of HO Information & Services materials as requires payment.
7. Order Placement, Acceptance and Refunds
7.1 If you order a subscription, service or product, payment must be received by us before your order is accepted. We may require additional information regarding your order if any required information was missing or inaccurate, and may cancel or limit an order any time after it has been placed. Your electronic order confirmation, or any form of confirmation, does not signify our acceptance of your order.
7.2 Under Australian consumer law, a retailer must provide a repair, replacement or refund if an item is faulty or significantly not as described. Refunds for change of mind are not a legal obligation. We would like to ensure that our Users are pleased with the educational material that we provide. Considering our aim and Mission Statement, which include building a community of like-minded people, we offer the following conditions for consideration of a partial refund (minus merchant fees and a $20(AU) admin fee:
- change of mind will not be considered
- written request for a refund must be received within 2 days of subscription or purchase. You must not have completed more than 60% of the course. Requests must be in writing to info@helponline.com.au and a reason needs to be provided for your dissatisfaction to enable us to implement quality assurance processes
- for health professionals, whereby courses include a certificate of completion, refunds that will be not issued if you have downloaded a certificate of completion
7.3 Following a refund being processed, we have the right to prevent future access to HO Information & Services or purchases of any of our other products or services in order to protect our intellectual property.
8. Products, Services and Prices Available on the Website
8.1 Products, services, and prices advertised on HO Information & Services are subject to change from time to time, which may include occasional promotions. Any terms and conditions associated with promotions will be made available at the same time and the promotion and before your participation in that promotion. HELP Online reserves the right, without notice, to discontinue provision of or access to HO Information & Services or modify specifications and prices on products and services without incurring any obligation to you. Except as otherwise expressly provided for in these Terms, any price changes to your subscription or purchase of HO Information & Services or other product(s) this will take effect following reasonable email notice to you. If you disagree with a change in the price of our subscription services, you may cancel your subscription rather than continuing at the higher amount.
8.2 Subscriptions purchased include 12 months of access from the date of purchase.
8.3 We use our best attempts to review medical scientific literature to support the HO Information & Services as new scientific and medical information is created. HELP Online accepts no responsibility for the accuracy of content and does not warrant that any or all information provided is current nor up-to-date. (See further information in our disclaimer sections).
8.3 The HELP Online Facebook and Membership areas are being trialled only and can be discontinued at HELP Online’s discretion. They will only be continued if it is viable to maintain such a service as a lymphoedema physiotherapist needs to be available to update the content accordingly. Active members to membership subscription areas will be notified by email if HELP Online plans to cancel the membership areas with 30 days of notice provided. Access to existing content in the Membership area will remain available until the end of your 12 month subscription, but no further .
9. Testimonials 
9.1 HELP Online is pleased to hear from Users and welcomes your comments regarding HO Information & Services and products through social media platforms (such as Facebook, Facebook Messenger, LinkedIn, Instagram) as well as direct to our email address at info@helponline.com.au. HELP Online may use testimonials and/or product reviews in whole or in part together with the name, qualification and country of the person submitting it. Testimonials may be used for any form of activity relating to HELP Online’s services or products, in printed and online media, as HELP Online determines in its sole and exclusive discretion.
9.2 Testimonials represent the unique experience of the participants and customers submitting the testimonial, and do not necessarily reflect the experience that you may have using HO Information & Services or products. Note that testimonials, photographs, and other information that you provide to us will be treated as non-confidential and non-proprietary, and, by providing them, you grant HELP Online a royalty-free, worldwide, perpetual, non-exclusive and irrevocable license to use them. We will always ask for permission to use any testimonial received before initially posting the testimonial on our website or to social media platforms.
9.3 Additionally, HELP Online reserves the right to correct grammatical and typing errors, to shorten testimonials prior to publication or use, and to review all testimonials prior to publication or use. HELP Online shall be under no obligation to use any, or any part of, any testimonial or product review submitted and may decline or remove any material posted which HELP Online considers to be false, inaccurate or defamatory. HELP Online will seek your consent before making any use of any Testimonial.
10. Disclaimers of Other Warranties
10.1 Except where otherwise inapplicable or prohibited by law, HO Information & Services and all content are provided “as is”, “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of as to currency or title or implied warrantied of merchantability or fitness for a particular purpose. We make no, and expressly disclaim any and all, representations and warranties as to the reliability timeliness, quality, suitability, availability, accuracy, currency and or completeness of any information within HO Information & Services and products.
10.2 The materials appearing on HO Information & Services may include technical, typographical, or photographic errors. HELP Online does not warrant that any of the materials the HO Information & Services are accurate, complete, or current. HELP Online may remove and or make changes to the materials contained on its web site at any time without notice. HELP Online does not, however, make any commitment to update the materials.
10.3 By subscribing to any HO Information & Services, such as “A guide to understanding the early detection of Lymphoedema,” you understand that the information is not intended to assist you to self-diagnose Lymphoedema and you will not know if you have or will develop Lymphoedema without consulting a health professional. By subscribing to any HO Information & Services on “the management of Lymphoedema,” you understand that if you have previously been diagnosed with Lymphoedema by a health practitioner, your Lymphoedema may not improve. Patient case studies and scientific research results described are only for demonstration and information purposes and the information provided may not be appropriate to you or your circumstances. You must see your doctor or qualified Lymphoedema therapist for individual medical advice pertaining to your health needs, the prevention, risk reduction, diagnosis and treatment of Lymphoedema or any medical conditions.
11. Dispute Resolution by Mandatory Binding Arbitration and Class Action Waiver
11.1 This website has been created in Sydney, Australia and therefore has been created under Commonwealth of Australia and Australian Courts of Law. If you are outside of Australia and you use the HO Information & Services, your use of the HO Information & Services is at your own risk and discretion. Any overseas claims will need to be dealt with in Sydney, Australia.
11.2 Except where prohibited by law, you agree that any claim that you may have in the future must be resolved through final and binding confidential arbitration to occur in Sydney, Australia and under Australian law. You acknowledge and agree that you are waiving the right to a trial by jury. The rights that you would have if went to court, such as discovery or the right to appeal, may be more limited or may not exist. You agree that you may only bring a claim in an individual capacity and not as a plaintiff (lead or otherwise) or class member in any purported class or representative proceeding. You further agree that the arbitrator may not consolidate proceedings or claims or otherwise preside over any form of a representative or class proceeding.
11.3 There is no judge or jury in arbitration and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damaged and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow these terms as court would.
12. Release and Indemnity
12.1 To the fullest extent permitted by law, you agree to release, defend, indemnify, and hold harmless the Australian Institute of Lymphoedema Pty Ltd, its directors, any educators, health professionals or patients featured in the the HO Information & Services content, officers, employees, shareholders, licensors, independent contractors, subcontractors, suppliers, affiliates, parent companies, subsidiaries, and agents from and against any and all claims, demands, actions, loss, liabilities, damages, expenses, demands, and costs of any kind, including, but not limited to legal fees and costs of any litigation or other dispute resolution, arising out of, resulting from, or in any way connected with or related to (1) your use, misuse, or attempt to use the HO Information & Services material, courses, products, or services, (2) information you submit or transmit through the HO Information & Services (3) your health, health status and health care.
13. Third-Party Links

14. Affiliates
14.1 HELP Online may provide some organisations and individuals, such as health professionals, cancer and Lymphoedema advocacy organisations, a proportion of subscription and or sale proceeds based on HO Information & Services referrals. Providers of the referrals are referred to as affiliates (Affiliates). An Affiliate is not an employee or contractor of HELP Online. Affiliates are not permitted by HELP Online to represent that they work for HELP online, own any of its intellectual property or rights to information comprised in HO Information & Services.
15. Your Additional Representations and Warranties
15.1 You hereby further represent and warrant: (1) that you are at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is greater; (2) have read these Terms and our Privacy Policy available above and thoroughly understand and agree to them, including the fact that the HO Information & Services provides general information education purposes only and are not designed to replace seeking appropriate medical care and individualised advice from a qualified health professional; and (3) that you will not resell, re-distribute, photocopy for re-use or export any HO Information & Services material, product or service that you order from or download from the HO Information & Services. You further represent that HELP Online has the right to rely upon all information provided to HELP Online by you, and HELP Online may contact you by email, telephone, or postal mail for any purpose, including but not limited to (i) follow-up calls, (ii) satisfaction surveys, and (iii) inquiries about any orders you placed, or considered placing, on or through the HO Information & Services.
16. Severability
16.1 If any provision of these Terms is found by the arbitrator or (if proper) a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall not be affected thereby and shall continue in full force and effect and such provision may be modified or severed from these Terms to the extent necessary to make such provision enforceable and consistent with the remainder of these Terms.
17. Entire Agreement
17.1 These Terms, and any policies or operating rules posted by us or in respect to the HO Information & Services in force at the time or times you access the HO Information & Services constitutes the entire agreement and understanding between you and HELP Online and governs your access to and use of the HO Information & Services and your ordering, purchasing, subscribing to and use and/or attempted use of any service or product , and supersedes and replaces any prior or contemporaneous agreements, representations, communications, and proposals, whether oral or written, between you and HELP Online. We may also, in the future, offer new services and/or features through the HO Information & Services. Such new features and/or services shall also be subject to these Terms, and any policies or operating rules posted by us in these Terms at the time of accessing the HO Information & Services. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

It is your responsibility to check the HO Information & Services periodically for changes. The Terms and text of Privacy Policy to apply from time to time are those posted to the relevant the HO Information & Service at the time of any particular download or access. 18.3 Use of the HO Information & Services after such changes constitutes acceptance of such changes.
